Terms of Service
These Terms of Service (the "Terms") govern your use of the trivia mobile applications published by FLATMAP SRL ("FLATMAP", "we", "us", "our") on the Apple App Store (each, the "App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Acceptance and eligibility
You may use the App only if you are at least 13 years old (or at least 16 years old if you live in the European Union). By using the App you confirm that you meet this age requirement.
2. Your account
You may use the App with an anonymous account or with an email-linked account. You are responsible for activity that occurs under your account. You must choose a username that complies with Apple's App Store guidelines (no offensive, infringing, or impersonating names). We may rename or remove usernames that violate these rules.
3. Subscriptions
The App offers auto-renewing subscriptions for premium features. Important details:
- Subscriptions are billed by Apple through your App Store account.
- Your subscription auto-renews at the end of each period unless you cancel at least 24 hours before the renewal date.
- Renewal charges are made within the 24-hour window before the period ends.
- You can manage and cancel your subscription in iOS Settings → Apple ID → Subscriptions.
- Refunds, where permitted, are handled by Apple per the App Store terms, except where applicable consumer law provides otherwise.
4. In-app purchases (lives)
The App lets you buy bundles of "lives" — virtual items used to play more games. Lives:
- Are virtual items with no monetary value.
- Are non-transferable and non-refundable, except where required by applicable law.
- EU consumers acknowledge that, by using the lives immediately upon purchase, the right of withdrawal under EU consumer law expires once the lives have been used or consumed.
- May expire if you delete your account.
All payments are processed by Apple. We do not see or store payment-card information.
5. Rewarded ads
You may earn lives by watching rewarded video ads served by Google Mobile Ads (AdMob). We do not control ad creative content and do not warrant any product or service advertised in the App.
6. Acceptable use
You agree not to:
- Cheat, exploit bugs, automate gameplay, or use third-party tools to gain an unfair advantage.
- Reverse engineer, decompile, or attempt to extract the source code of the App.
- Share, sell, or transfer your account.
- Harass other players or post offensive content (e.g. as a username).
- Use the App in any way that violates law or these Terms.
We may suspend or terminate accounts that violate these rules, without notice where necessary.
7. Service availability
The App is an always-online service. We do our best to keep it available but do not guarantee uptime, and we may take the App offline for maintenance, upgrades, or to comply with law. We do not commit to any service-level agreement at this stage.
8. Intellectual property
The App — including its code, artwork, fonts, sounds, design, and trademarks — is owned by FLATMAP SRL or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for non-commercial entertainment, subject to these Terms.
9. Disclaimers
The App is provided "as is" and "as available", without warranties of any kind, express or implied, except as required by mandatory law. We do not warrant that the App will be error-free, uninterrupted, secure, or that defects will be corrected.
10. Limitation of liability
To the maximum extent permitted by law, FLATMAP SRL's total aggregate liability arising out of or relating to the App or these Terms is limited to the amount you paid to us in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under applicable consumer-protection law.
11. Indemnity
You agree to indemnify and hold FLATMAP SRL harmless from claims arising from your breach of these Terms or your misuse of the App, except where limited by law.
12. Governing law and jurisdiction
These Terms are governed by the laws of Belgium, without regard to its conflict-of-laws rules. Disputes will be brought before the competent courts of Brussels, without prejudice to any mandatory consumer-protection venue available to you under your local law.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be flagged in the App and the "Effective" date at the top will be updated. Continued use of the App after the change constitutes acceptance of the new Terms.
14. Apple as third-party beneficiary
You acknowledge that these Terms are between you and FLATMAP SRL, not Apple. Apple is not responsible for the App or its content. Apple is, however, a third-party beneficiary of these Terms and may enforce them against you.
